Whoever lodges an application at the National Center of Intellectual Property in Minsk first gets the rights here. Your brand might have been famous in Paris for twenty years \u2014 it doesn&#8217;t enter the equation. So<a href=\"https:\/\/opencompanyinbelarus.com\/eng\/pages\/trademark-registration-in-belarus\"> trademark registration<\/a> is something to handle before the trucks arrive, not after. Below: why the rule bites, what three filing routes are open to you, and how much time you actually need to plan for.<\/p>\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_structural_reality_first-to-file\"><\/span><strong>The structural reality: first-to-file<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p class=\"wp-block-paragraph\">Here&#8217;s how the rule works. The <a href=\"https:\/\/etalonline.by\/document\/?regnum=v19302181\">Law on Trademarks and Service Marks<\/a> gives you rights in a mark once you&#8217;ve registered it in Belarus. Not before. Foreign use won&#8217;t do it. Foreign registrations won&#8217;t do it. Reputation helps in a handful of narrow disputes, and that&#8217;s about as far as it goes.<\/p>\n\n<p class=\"wp-block-paragraph\">So now ask who&#8217;s watching your brand. Your competitor. A distributor you&#8217;ve fallen out with. People whose business is registering other people&#8217;s brands and waiting for them to come asking. Any one of them can beat you to NCIP. Once they&#8217;re on the register, they&#8217;re the owner, and you&#8217;re the one who has to pay them to walk away. None of this is unique to Belarus. Every first-to-file country works the same way. So does the way out: get there first.<\/p>\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Three_routes_to_protection\"><\/span><strong>Three routes to protection<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p class=\"wp-block-paragraph\">If you&#8217;ve decided to register, you have three options. Pick the one that matches your wider footprint.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>The national route \u2014 NCIP in Minsk<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">The workhorse. You file directly with the <a href=\"https:\/\/ncip.by\/en\/o-centre\/novosti\/services_and_information\/the-main-stages-and-requirements-for-trademark-registration-in-belarus\/\">National Center of Intellectual Property<\/a> (NCIP) in Minsk. Multi-class applications are allowed, so you can cover several classes of goods or services in one filing. Foreign applicants act through a Belarusian patent or trademark attorney \u2014 there is no way around this, with narrow exceptions for Russian and Ukrainian citizens. This is the right route if Belarus is your only target, or if you want maximum control over the local prosecution.<\/p>\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Madrid_Protocol_%E2%80%94_extending_an_international_registration\"><\/span><strong>Madrid Protocol \u2014 extending an international registration<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n<p class=\"wp-block-paragraph\">Already filing in several countries? Then Madrid usually beats running parallel national applications. Belarus has been a <a href=\"https:\/\/www.wipo.int\/members\/en\/details.jsp?country_id=27\">Madrid Protocol member<\/a> since 2001, so you can designate it through WIPO inside the same international application you&#8217;re using for everywhere else. One filing for you to manage. One renewal cycle to track. Records sit in one place at WIPO instead of scattered across national offices.<\/p>\n\n<p class=\"wp-block-paragraph\">Where Madrid stops being a shortcut is the provisional refusal. NCIP comes back with one and you&#8217;ll still need a Belarusian attorney to respond, and the response timeline isn&#8217;t necessarily faster than a national filing would have been. For most multi-country owners, that&#8217;s a price worth paying. For anyone whose only target is Belarus, it usually isn&#8217;t.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>The EAEU regional trademark \u2014 a route to watch<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">The most ambitious option is a regional registration covering Armenia, Belarus, Kazakhstan, Kyrgyzstan and Russia in one filing. The EAEU Treaty on Trademarks, Service Marks and Appellations of Origin of 3 February 2020 entered into force on 26 April 2021, and Belarus has incorporated the framework into its own registration <a href=\"https:\/\/pravo.by\/document\/?guid=3871&amp;p0=C20901719\">regulation<\/a>. The honest caveat: the regional system has been moving into full operation slowly. A typical Belarusian trademark registration takes around 11 to 14 months from filing to certificate. Difficult cases \u2014 with refusals, third-party objections, or amendments \u2014 can stretch the process to around 28 months. Expedited processing is available in some circumstances and can compress the timeline meaningfully, but it isn&#8217;t free and isn&#8217;t always advisable.<\/p>\n\n<p class=\"wp-block-paragraph\">Read that against your launch plan. If you want a registered mark in your hand on the day your goods clear the Belarusian border, you started filing the year before. &#171;Before market entry&#187; is not a slogan; it is the only way the math works.<\/p>\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_the_procedure_actually_looks_like\"><\/span><strong>What the procedure actually looks like<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p class=\"wp-block-paragraph\">End to end, a national filing moves through a recognisable sequence. A preliminary search of the NCIP register flags any clashes before you spend money on a doomed application. The application itself is filed through your Belarusian patent attorney, with a notarised power of attorney from you that has been <a href=\"https:\/\/opencompanyinbelarus.com\/eng\/pages\/documents-legalization-apostille\">apostilled or consularly legalised<\/a> abroad and translated into Russian. The NCIP then runs a formal examination \u2014 roughly two months, checking that documents and fees are in order \u2014 followed by a substantive examination, which is the longest stage and where distinctiveness and conflicts with earlier rights are tested. If everything passes, the mark is registered in the State Register of Trademarks and a certificate is issued within about a month of registration.<\/p>\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_protection_do_you_actually_get\"><\/span><strong>What protection do you actually get<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p class=\"wp-block-paragraph\">A Belarusian registration gives you the exclusive right to use the mark, for the goods and services in the classes you specified, for 10 years from the filing date \u2014 renewable every 10 years indefinitely on payment of the fee. The practical decision is the class list itself. If you operate, or will operate, through a local <a href=\"https:\/\/opencompanyinbelarus.com\/eng\/pages\/open-llc-in-belarus\">limited liability company<\/a>, line the classes up with what the company will actually trade in. Too narrow and you leave gaps a competitor can register around; too broad and you invite the non-use challenge described next.<\/p>\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Use_it_or_lose_it_the_three-year_non-use_rule\"><\/span><strong>Use it or lose it: the three-year non-use rule<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p class=\"wp-block-paragraph\">This is the rule that catches foreign brands that file defensively and forget. After roughly three years from registration, a mark that has not been put to genuine use in Belarus becomes vulnerable to cancellation by third parties on non-use grounds. Defensive filings have their place, but they are not a substitute for trading. If your plan is to enter the Belarusian <a href=\"https:\/\/opencompanyinbelarus.com\/eng\/pages\/it-company-registration-in-belarus\">IT or technology market<\/a> through a High-Tech Park company, structure both pieces \u2014 the trademark and the operating entity \u2014 so that the mark is used in real commerce within the three-year window.<\/p>\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Enforcement_after_registration\"><\/span><strong>Enforcement after registration<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p class=\"wp-block-paragraph\">Once registered, you have real tools. Belarusian law allows civil claims for compensation and injunctions against infringers, administrative liability for minor cases, and criminal sanctions for the most serious cases. There is also a border-control lever worth using: a registered mark can be recorded with the Belarusian Customs Register of IP Objects (TROIS), so customs officers can intercept infringing goods at the frontier rather than chase them inside the country.
